Results of NCCIR meeting dated July 28, 2020

NCCIR issued five licenses for the use of radio frequency resource of Ukraine (RFMC of Ukraine), two licenses for an additional frequency resource (RF) bandwidth and extended the validity of two licenses for the use of RFMC of Ukraine. According to NCCIR decision “The Unified State Register of Postal Telecommunications Operators” was supplemented with one operator. The Commission decided to regulate the numbering resource. These and the other decisions were adopted during the regular NCCIR meeting on July 28, 2020.

In accordance to the Law of Ukraine “On Radio Frequency Resource of Ukraine”, according to the applications of economic entities the Commission issued five licenses for the use of RFMC of Ukraine for a term of 5 years to:

  • a sole proprietor Voronina I.V. - two licenses for broadband radio access (a radio data transmission system using noise-shaped signal) in Kharkiv Oblast;
  • NETSAT-SERVIS, LLC - two licenses for broadband radio access (a radio data transmission system using noise-shaped signal) in Sumy Oblast;
  • IUHTELEHRUPP, LLC - a license for broadband radio access (a radio data transmission system using noise-shaped signal) in Zaporizhzhia Oblast.

By the same decision the Commission issued two licenses for an additional frequency resource (RF) bandwidth for a term of 5 years to:

  • TELEKOMUNIKATSIYNA KOMPANIIA ZURBAHAN, LLC - for broadband radio access (a radio data transmission system using noise-shaped signal) in Sumy Oblast;
  • DATAGROUP, PJSC - for broadband radio access (a radio data transmission system using noise-shaped signal) in Dnipropetrovsk Oblast.

NCCIR extended the validity of one license for the use of RFMC of Ukraine to RIVNE TELEKOM, LLC - a license for multiservice radio access (radio communication in multi-channel distribution systems for transmission and retransmission of television image, sound transmission, digital information) in Rivne Oblast from November 30, 2020 till November 29, 2025.

In accordance with the paragraph 1 of Part 2 and Part 4 of Article 45 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, taking into account the letter of Ukrainian State Centre of Radio Frequencies, State Enterprise concerning the permits for operation, due to the cancellation of a license for the use of RFMC of Ukraine, NCCIR has revoked four permits for REFs* operation in connection with the revocation of the license for use the RFMC of Ukraine to:

  • TOP NET, PJSC - two permits for operation of REFs (this decision shall be enforced simultaneously with the implementation of paragraph 1 of the decision of NCCIR from 14.07.2020 № 265 on the basis of part six of Article 38 of the Law of Ukraine "On Radio Frequency Resource of Ukraine";
  • NET ON LAIAN, LLC - two permits for operation of REFs (this decision shall be enforced simultaneously with the implementation of paragraph 1.2 of the decision of NCCIR from 14.07.2020 № 266 on the basis of part six of Article 38 of the Law of Ukraine "On Radio Frequency Resource of Ukraine".

In accordance with the Part 2 of Article 37 of the Law of Ukraine "On Radio Frequency Resource of Ukraine" and in connection licensee's failure to comply with the conditions specified in the license through its own fault (violation of conditions of subparagraphs 4.1.11 and 4.1.19 of paragraph 4.1 of the License Terms of use of RFMC of Ukraine), NCCIR has refused to a sole proprietor Severenchuk M.V. to extending the validity of a license for multiservice radio access (radio communication in multi-channel distribution systems for transmission and retransmission of television image, sound transmission, digital information) in Poltava Oblast.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF and RC**), the Commission added the information to Section I of the Register of REF and RC about one type of radio facility.

In accordance with Article 26 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Regulations on the Procedure and the Form of Maintaining the Register of REF and RC, upon examination of the applications of BROADCASTING COMPANY ''SVOBODA.FM'', LLC and of HUAWEI UKRAINE, LLC concerning the possibility of applying the particular type of REF or RC in the territory of Ukraine, and according to the results of technical expertise on issues of electromagnetic compatibility of declared REF type, NCCIR identified as possible the use of one type of radio electronic facilities in the territory of Ukraine and by the same decision amended to addition 1 of the decision of NCCIR of 24.03.2020 № 124 "On determining the possibility of using electronic means in the territory of Ukraine" (as amended), setting out positions 4 and 5 in the new version.

In accordance with the Part 6, Article 8 of the Law of Ukraine “On Postal Communication”, with the Procedure for Conducting the Unified State Register of Postal Telecommunications Operators, on the basis of notification, NCCIR has included information into “The Unified State Register of Postal Telecommunications Operators” about one operator EDIT GROUP, LLC which will provide services for mail receiving, mail processing, transportation and delivery of postal items, in the territory of Ukraine; except for the occupied territories; international reception, processing and transportation of postal items, as well as execution of user orders for postal transfers from the territory of the EU: Germany, Italy, Spain, Portugal, Greece, Austria, Estonia, Latvia, Lithuania, Poland, Hungary, Cyprus, Czech Republic, Bulgaria, Croatia, Romania, Slovenia, Hungary.

In accordance with the Law of Ukraine “On Telecommunications” and in accordance with the Provisions on the State Regulation of the Numbering Resource of the Public Telecommunications Network of Ukraine (hereinafter – the Provisions) and in accordance with the subparagraph 8.3.1 of the Regulation (inaccuracy of data specified in the operator's statement and in the documents attached to it), according to the applications of KYIVSTAR JSC, NCCIR refused to reissuance of permits for the use of numbering resource with a total capacity of 559,800 numbers, one transit signaling code of SS-7 network, national identification code 897 of the destination network in the territory of Ukraine, code 03-ХХ-Х of the SCS-7 network in the territory of Ukraine; code 56-ХХ-Х of the SCS-7 network in the territory of Ukraine; codes 52-X1X2-X3, where: X1X2 = (00-63); X3 = (0-3) signaling points of the SCS-7 network in the territory of Ukraine.
