Results of NCCIR meeting dated 19 November 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 11 positions. NCCIR issued four licenses for an additional RF bandwidth and extended the validity of two licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on November 19, 2019.

According to the Commission’s decision, two operators and nine providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, 13 economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: Spozhyvche tovarystvo “Khvylia”; TELERADIOKOMPANIIA “ENERHETYK PLIUS”, LLC; Internet Servis Provaider “Skainet”, LLC; KALANCHAK.NET, Private Enterprise; MEHA-INET, LLC; MEHAPROSTIR, LLC; the sole proprietors Koval D.O.; Liubymyi K.M.; Liubyma O.V.; Siryk Yu.A.; Perov O.O.; Dovbnia K.M.; Mindak N.A.

In connection with the termination of activities in the telecommunications sector and according to the applications of sole proprietors, NCCIR excluded from “The Register of Telecommunications Operators and Providers” three sole proprietors: RADIOPEREDAVALNYI TSENTR TELERADIOKOMPANIIA “EFIR”, Private Enterprise; Kulchenko O.B. and Shumskyi D.V.

In connection with the termination of activity in the telecommunications sector, which is confirmed by information from the Unified State Register of Legal Entities, Sole Proprietors and Public Associations, which are in accordance with Part 1 of Article 10 of the Law of Ukraine “On State Registration of Legal Entities, Sole Proprietors and Public Associations” are considered reliable and can be used in a dispute with a third party, NCCIR excluded 29 economic entities from “The Register of Telecommunications Operators and Providers”, as follows: Liskova M.Ia.; Mytsyk V.V.; Hrabar O.V.; Semenovskyi A.I.; Dubynskyi V.V.; Didenko L.V.; Subbotka O.S.; Chebrushkov M.O.; Yarova A.O.; Marchuk O.Ie.; Shevel O.I.; Rudnovska V.B.; Halyha L.V.; Bilash M.B.; Nefodov Ye.O.; Bondarenko O.V.; Orlenko O.S.; Ponomarov Ye.M.; Kaplun D.V.; Pylypenko S.V.; Buhaienko Yu.V.; Harhalyk O.Iu.; Kachaniuk I.L.; Babak O.O.; Shevchuk O.O.; Antypov A.V.; Mastak S.V.; Martsynkevych V.A. and Popadiuk M.V.

According to the applications of economic entities, the Commission issued four licenses for an additional RF bandwidth for a term of 5 years to:

  • Spozhyvche tovarystvo “AIST terytorialnyi partner v Ukraini” – a license for broadband radio access (a radio data transmission system using noise-shaped signal) in Odesa Oblast;
  • INTERNATSIONALNI TELEKOMUNIKATSII, LLC – three licenses for digital cellular radio communication of CDMA-800 standard in: Dnipropetrovsk Oblast; Donetsk, Luhansk, Poltava, Kharkiv Oblasts; Dnipropetrovsk, Zaporizhzhia Oblasts and in Sevastopol city.

Due to decrease of RF bandwidth, NCCIR re-isued two licenses for the use of radio frequency resource to:

  • SkaiTel UA, LLC – a license for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in Vinnytsia Oblast with the period of validity till August 26, 2023;
  • Broadcasting, Radiocommunications and Television Concern – a license for radio link communication (radio link communication of fixed radio service) in Chernivtsi Oblast with the period of validity till October 08, 2021.

The Commission extended the validity of two licenses for the use of radio frequency resource of Ukraine to:

  • BIELNET, LLC – a license for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in Odesa Oblast from May 19, 2020 till May 18, 2025;
  • POLTAVARADIOKOM, LLC – a license for digital trunked radio communication in Poltava Oblast from March 06, 2020 till March 05, 2025.

In accordance with the paragraph 1 of Part 1 of Article 38 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine”, NCCIR has cancelled to NORMATEK. INK., LLC a license for the use of radio frequency resource of Ukraine for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in Kyiv city.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF* and RC**), NCCIR added the information to Section I of the Register of REF and RC about one type of radio facility.

In accordance with the Law of Ukraine “On Telecommunications” and in accordance with the Provisions on the State Regulation of the Numbering Resource of the Public Telecommunications Network of Ukraine (hereinafter – the Provisions), according to the application, the Commission issued the numbering resource to Regional Center of Emergency Medical Care and Disaster Medicine of Dnipropetrovsk Regional Council, Municipal Enterprise:

  • the final destination signaling code of SS7 network in Dnipro city;
  • the final destination signaling code of SS7 network in Kryvyi Rih city (Dnipropetrovsk Oblast) and issued relevant permits for a term of 10 years (from December 02, 2019 till December 01, 2029).

NCCIR re-issued to TASKO, LLC a permit for the use of numbering resource with the capacity of 5.000 phone numbers in Chernihiv city in accordance with subparagraph 7.2.2 of the Provisions (the extension of the validity period of the license).

In accordance with subparagraph 10.1.3 of the Provisions (if the license expires), the Commission has withdrawn from KORSI, LLC a numbering resource with the capacity of 1.000 phone numbers in Uzhhorod city; with the capacity of 500 phone numbers in Barvinok village (Uzhhorod Raion, Zakarpattia Oblast); the final destination signaling code of SS7 network in Uzhhorod city.

In accordance with paragraph 5 of Article 18 of the Law of Ukraine “On Telecommunications”, the National Numbering Plan of Ukraine, approved by the order of the Ministry of Transportation and Communication of Ukraine, dated 23 November 2006 No. 1105 and registered at the Ministry of Justice of Ukraine on December 07, 2006 under No. 1284/13158, the Regulations on the State Regulation of the Numbering Resource of the Public Telecommunications Network of Ukraine, approved by the NCRC decision dated 01 June 2007 No. 769 and registered at the Ministry of Justice of Ukraine on June 20, 2007 under No. 679/13946, taking into account the letter of the Ministry of Social Policy of Ukraine and the letter of state authority “Government Contact Center” concerning the possibility of using a short four-digit telephone number for the organization of social focus “directory assistance service” with the use of opportunities of fixed and mobile operators, according to the relevant applications of KYIVSTAR, PJSC; lifecell, LLC; VF UKRAINE, PJSC and Ukrtelekom, PJSC, NCCIR adopted the decision to allocate a short number 1539 for the organization of directory assistance service “Counseling and Providing Feedback for Persons with Disabilities” and a short number 1548 for the organization of directory assistance service “Anti-Smuggling Activities and Corruption During Customs Clearance of Goods” for the use in the mobile communications networks with identification codes of these mobile communications operators in the territory of Ukraine.
