Results of NCCIR meeting dated 10 September 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 11 positions. NCCIR issued two licenses, re-issued one license and extended the validity of two licenses for the use of radio frequency resource of Ukraine. NCCIR added the information to Section I of the Register of REF and RC about three types of radio facilities. These and the other decisions were adopted during the regular NCCIR meeting on September 10, 2019.

According to the Commission’s decision, two operators and nine providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, three economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: FAIBERKHOUM, LLC; ANDERNET, LLC and Radio Network, LLC.

According to the application of TELEKOMUNIKATSIINA KOMPANIIA STARNET, LLC, NCCIR issued a license for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Kharkiv Oblast for a term of 5 years.

According to the economic entity’s application, the Commission issued to a sole proprietor Chabanov A.O. a license for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Mykolaiv Oblast for a term of 5 years.

Due to decrease in the number of regions and according to the application of economic entity, NCCIR re-issued a license to YEVROLAIN – UKRAINA, LLC for the use of radio frequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) with the period of validity till February 24, 2020 in the territory of Kyiv Oblast.

By the same decision, according to the application of economic entities, the Commission extended the validity of two licenses for the use of radio frequency resource of Ukraine to:

  • DATAGROUP, PJSC – a license for digital wireless telephony (radio communication in the system with a fixed subscriber radio access of DECT standard) from December 28, 2019 till December 27, 2024 in the territory of Kyiv and Sevastopol cities, and also in Vinnytsia, Volyn, Donetsk, Zhytomyr, Zaporizhzhia, Ivano-Frankivsk, Kyiv, Mykolaiv, Rivne, Sumy, Kharkiv, Kherson and Cherkasy Oblasts;
  • Kyivstar, PJSC – a license for radio link communication (radio link communication of fixed radio service) from December 30, 2019 till August 29, 2034 in the territory of Kyiv, Cherkasy, Donetsk, Chernihiv and Luhansk Oblasts.

In accordance with the paragraph 1 of Part 1 of Article 38 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine” and according to the economic entity’s application, NCCIR has adopted the decision to cancel a license for the use of radio frequency resource of Ukraine for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Sumy Oblast.

In connection with the failure to provide documents confirming the payment for the extension of the validity period of the licenses for the use of radio frequency resource of Ukraine, in accordance with Part 3 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Commission canceled the paragraphs 3.5 and 3.6 of NCCIR decision dated July 30, 2019 No. 354 concerning the extension of the validity period of the licenses for the use of radio frequency resource of Ukraine to “TST, LTD”, LLC.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF* and RC**), NCCIR added the information to Section I of the Register of REF and RC about three types of radio facilities.
