Results of NCCIR meeting dated 30 July 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 19 positions. NCCIR re-issued one license and extended the validity of three licenses for operating in telecommunications sector. The Commission issued three licenses for an additional RF bandwidth, re-issued one license and extended the validity of six licenses for the use of radio frequency resource of Ukraine. Also, NCCIR issued six and re-issued eight permits for the use of numbering resource. These and the other decisions were adopted during the regular NCCIR meeting on July 30, 2019.

According to the Commission’s decision, eight operators and 11 providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, six economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: the sole proprietors Hladii V.V., Merchuk A.M. and Hrebeniak I.V.; VAN TELEKOM, LLC; HIHATRANS UKRAINA, LLC and BAZIS, LLC.

In connection with the termination of activities in the telecommunications sector, according to the applications of economic entities, NCCIR excluded from “The Register of Telecommunications Operators and Providers” nine economic entities: the sole proprietors Dryha A.A., Vorobiov Ye.V., Ovsiienko V.S., Peleshko R.I., Kyshchuk A.V.; TAUNLAN H4, LLC; AKTYVNET H1, LLC; TREIDOM, LLC and INTERKOM-TSENTR, Private Enterprise.

Due to the change of legal entity’s name and location, NCCIR re-issued a license to PROMSPETSZVIAZOK, State Enterprise, for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels for the use in the territory of Dnipro city and Dnipropetrovsk Oblast.

By the same decision, according to the applications of economic entities, the Commission extended the validity of three licenses:

  • two licenses for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels for the use to: Ukrainian State Air Traffic Services, State Enterprise in the territory of Kyiv city from January 14, 2020 till January 13, 2025 and ZAKHIDNO-YEVROPEISKI TELEKOMUNIKATSII, LLC in the territory of Zakarpattia Oblast from February 22, 2020 till February 21, 2025;
  • a license for the provision of engineering maintenance services and telecom networks operation to a sole proprietor Panchuk Ye.V. in the territory of Kyiv city from January 28, 2020 till January 27, 2025.

According to the applications of economic entities, NCCIR issued three licenses for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) for a term of 5 years to:

  • SOLVER, Research and Development LLC – a license for the use of radio frequency resource in the territory of Poltava Oblast;
  • FASTTELEKOM LTD, LLC – a license for the use of radio frequency resource in the territory of Kyiv city;
  • Broadcasting, Radiocommunications and Television Concern – a license for the use of radio frequency resource in the territory of Ivano-Frankivsk Oblast.

Due to decrease of RF bandwidth, according to the application of spozhyvche tovarystvo “AIST terytorialnyi partner v Ukraini”, the Commission re-issued one license for the use of radio frequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Odesa Oblast with the period of validity till October 07, 2021.

By the same decision, according to the applications of economic entities, NCCIR extended the validity of six licenses for the use of radio frequency resource of Ukraine to:

  • TV and Radio Studio “Impuls”, Private Enterprise – a license for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) from December 24, 2019 till December 23, 2024 in the territory of Vinnytsia Oblast;
  • FARLEP-INVEST, PJSC – two licenses for multiservice radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) from November 30, 2019 till November 29, 2024: in the territory of Kyiv city, Kharkiv, Donetsk, Dnipropetrovsk Oblasts; and in the territory of Kyiv city, Kharkiv, Donetsk, Dnipropetrovsk, Zaporizhzhia, Odesa Oblasts;
  • Kyivstar, PJSC – a license for radio link communication (radio link communication of fixed radio service) from November 17, 2019 till November 16, 2024 in the territory of Kyiv city, Kyiv, Vinnytsia, Dnipropetrovsk, Donetsk, Zhytomyr, Zaporizhzhia, Lviv, Odesa, Poltava, Kharkiv and Cherkasy Oblasts;
  • “TST, LTD”, LLC – two licenses for analog trunked radiocommunication in the territory of Odesa Oblast: from December 30, 2019 till December 29, 2024; and from January 13, 2020 till January 12, 2025.

In accordance with the paragraph 1 of Part 2 and Part 4 of Article 45 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, in connection with the cancellation of licenses for the use of radio frequency resource of Ukraine, the Commission has cancelled to:

  • a sole proprietor Kozytsia S.M. 18 permits for the REFs* operation;
  • a sole proprietor Spichkin A.M. 45 permits for the REFs operation.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF and RC**), the Commission added the information to Section I of the Register of REF and RC about three types of radio facilities – car radar devices of Bosch trademark (MRRe14FCR, LRR3 and MRR1Plus models) (manufacturer Robert Bosch GmbH, Germany).

In accordance with Article 26 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Regulations on the Procedure and the Form of Maintaining the Register of REF and RC, upon examination of the application of Farlep-Invest, PJSC concerning the possibility of applying the particular type of REF or RC in the territory of Ukraine, and according to the results of technical expertise on issues of electromagnetic compatibility of declared REF type, NCCIR identified as possible the use of one type of radio electronic facility in the territory of Ukraine – a subscriber transceiver (manufacturer Televideo, LLC; Ukraine).

In accordance with the Law of Ukraine “On Telecommunications” and in accordance with the Provisions on the State Regulation of the Numbering Resource of the Public Telecommunications Network of Ukraine, approved by the NCRC decision dated 01 June 2007 No. 769 and registered at the Ministry of Justice of Ukraine on June 20, 2007 under No. 679/13946 (hereinafter – the Provisions), and also according to the applications of economic entities, the Commission issued six permits for the use of numbering resource to:

  • BINOTEL, LLC – two permits for the use of numbering resource with the capacity of 10.000 phone numbers in Lviv city and the final destination signaling code of SS7 network in Lviv city;
  • Ukrtelekom, PJSC – three permits for the use of final destination signaling codes of SS7 network in: Milove township of Luhansk Oblast, Novoaidar township of Luhansk Oblast, Zachepylivka township of Kharkiv Oblast;
  • INTEL-KOM, LLC – a permit for the use of numbering resource with the capacity of 100 phone numbers in Uzhhorod city.

By the same decision, and according to the applications of economic entities, NCCIR re-issued eight permits for the use of numbering resource to:

  • Prykarpattiaoblenerho, PJSC – two permits: for the use of numbering resource with the capacity of 700 phone numbers and the final destination signaling code of SS7 network in Ivano-Frankivsk city in connection with the extension of the validity period of the licenses;
  • Danylo Halytskyi International Airport “Lviv”, State Enterprise – two permits: for the use of numbering resource with the capacity of 2.000 phone numbers and the final destination signaling code of SS7 network in Lviv city in connection with the extension of the validity period of the licenses;
  • ALMAZ TELEKOM, LLC – two permits: for the use of numbering resource with the capacity of 800 phone numbers and with capacity of 100 phone numbers in Lviv city in connection with obtaining new licenses;
  • INTEL-KOM, LLC – two permits: for the use of numbering resource with the capacity of 200 phone numbers and the final destination signaling code of SS7 network in Uzhhorod city in connection with the extension of the validity period of the licenses.

In accordance with subparagraph 10.1.3 of the Provisions, due to expiration of a license, the Commission has withdrawn the following numbering resource from:

  • DATAGROUP, PJSC: with the capacity of 2.000 phone numbers and the final destination signaling code of SS7 network in Yevpatoriia city (Autonomous Republic of Crimea); with the capacity of 3.000 phone numbers in Simferopol city and with the capacity of 3.000 phone numbers in Feodosiia city (Autonomous Republic of Crimea); the final destination signaling code of SS7 network in Simferopol city and the final destination signaling code of SS7 network in Feodosiia city (Autonomous Republic of Crimea);
  • T.R. Komiunikeishn, LLC – with the capacity of 1.000 phone numbers in Kharkiv city;
  • Firma “RADIO”, LLC – the final destination signaling code of SS7 network in Vinnytsia city.
