Results of NCCIR meeting dated 09 July 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 6 positions. NCCIR issued two licenses for operating in telecommunications sector. The Commission issued one license for an additional RF bandwidth and extended the validity of four licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on July 09, 2019.

According to the Commission’s decision, three operators and three providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, 11 economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: UKRAINSKI OPTYCHNI SYSTEMY, LLC; Teleradiokompaniia “TELELAN”, LLC; the sole proprietors: Hlushchenko L.A., Palamarchuk D.O., Haponiuk M.Ia., Semkovych-Kharyk L.Ia., Pavliuk N.I., Hladii M.M., Kniazieva U.R., Drobushar U.P. and Melnyk S.S.

In connection with the termination of activities in the telecommunications sector, according to the applications of economic entities, NCCIR excluded from “The Register of Telecommunications Operators and Providers” the sole proprietors: Kravchuk T.V., Tryfoniuk V.Iu., Yefimovskyi Ye.B.

In accordance with the Part 6, Article 8 of the Law of Ukraine “On Postal Communication”, according to the operator’s applications, NCCIR adopted the decision to add the information into “The Unified State Register of Postal Telecommunications Operators” about KOLTRANS, LLC – which will provide services for mail receiving, mail processing, transportation and delivery of postal items, execution of consumers’ requests on postal transfers, execution of consumers’ requests on banking operations in the whole territory of Ukraine, except the territories that are recognized as temporarily occupied; international mail receiving, processing and transportation, and also execution of consumers’ requests on postal transfers from the territory of EU countries (Belgium, Germany, Italy, Luxembourg, the Netherlands, France, Great Britain, Denmark, Ireland, Greece, Portugal, Spain, Austria, Finland, Sweden, Latvia, Lithuania, Estonia, Malta, Poland, Slovakia, Slovenia, the Czech Republic, Hungary, Cyprus, Bulgaria, Romania, Croatia).

According to the applications of economic entities, the Commission issued two licenses for the provision of engineering maintenance services and operation of telecom networks to: STARHRUP, LLC and DATANET ISP, LLC in the territory of Kyiv city for a term of 5 years.

Besides that, according to the applications of licensees, NCCIR issued copies of five licenses to:

  • lifecell, LLC – a copy of one license for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels for the use in the territory of Zaporizhzhia Oblast without the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use to the telecommunications provider DABL-YU NET YUKREIN, LLC;
  • INTERNATSIONALNI TELEKOMUNIKATSII, LLC – the copies of four licenses for the provision of fixed local telephony with the use of wireless access with application of CDMA technology with the rights of engineering maintenance and telecom networks operation, providing telecommunication channels in use to the telecommunications provider HIHATSENTR UKRAINA, LLC (without the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use) in such territories: the territory of Kyiv city, the territory of Odesa Oblast, the territories of Vinnytsia, Volyn, Zhytomyr, Ivano-Frankivsk, Zakarpattia, Kirovohrad, Mykolaiv, Sumy, Poltava, Rivne, Khmelnytskyi, Ternopil, Kherson, Cherkasy, Chernihiv, Chernivtsi, Kyiv Oblasts, Sevastopol city, the territories of Dnipropetrovsk, Donetsk, Zaporizhzhia, Luhansk, Lviv, Kharkiv Oblasts.

According to the application, the Commission issued a license for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) to a sole proprietor Nemyrovska O.Iu. in Vinnytsia Oblast for a term of 5 years.

NCCIR extended the validity of four licenses for the use of radio frequency resource of Ukraine according to the appropriate applications of economic entities:

  • two licenses to Keibl TV-finansy, LLC and Farlep-Invest, PJSC for multiservice radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in Donetsk Oblast from October 30, 2019 till October 29, 2024;
  • to Zheleznodorozhnyi tsekh, Small Private Enterprise for analog ultra-high frequency wireless telephony (radiocommunications of fixed, terrestrial and marine mobile radio service) in Odesa Oblast from October 30, 2019 till October 29, 2024;
  • to Halytski telekomunikatsii, LLC for broadband radio access (a radio data transmission system using noise-shaped signal) in Ternopil and Ivano-Frankivsk Oblasts from October 21, 2019 till October 20, 2024.

Due to decrease of RF bandwidth, the Commission re-issued to Keibl TV-finansy, LLC a license for multiservice radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Autonomus Republic of Crimea, Sevastopol city, Vinnytsia, Zhytomyr, Kyiv, Luhansk, Lviv, Mykolaiv, Sumy, Kherson Oblasts with the period of validity till January 20, 2020.

In accordance with Part 3 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” (in connection with the failure to provide documents confirming the payment for extending the validity of licenses for the use of radio frequency resource of Ukraine), NCCIR has cancelled the paragraphs 3.1, 3.2, 3.3, 3.4 of NCCIR decisions dated May 21, 2019 No. 236 on extending the validity of licenses for the use of radio frequency resource of Ukraine by PAN – TELEKOM, LLC.

In accordance with paragraph 3 of Part 5 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” (in connection with the unreliability of the data in the documents submitted by the applicant for obtaining a license and on the basis of the conclusions of Ukrainian State Centre of Radio Frequencies, State Enterprise concerning the possibility of issuing the licenses for the use of radio frequency resource of Ukraine, the Commission refused to NOVI TEKHNOLOHII-1, LLC in issuance of two licenses for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Kherson Oblast.

In accordance with the paragraph 1 of Part 1 of Article 38 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine”, according to the licensee’s application, NCCIR has adopted the decision to cancel two licenses to a sole proprietor Kozytsia S.M. for the use of radio frequency resource of Ukraine in the territory of Zaporizhzhia Oblast: for broadband radio access (a radio data transmission system using noise-shaped signal) and for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information).

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF* and RC**), the Commission provided the manufacturer “APTIV Services US LLC” (USA) with one code of registration number with the information included to Section II of the Register of REF and RC.
