Results of NCCIR meeting dated 02 July 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 19 positions. NCCIR issued two licenses and re-issued nine licenses for the use of radio frequency resource of Ukraine. The Commission re-issued 19 permits for the use of numbering resource. These and the other decisions were adopted during the regular NCCIR meeting on July 02, 2019.

According to the Commission’s decision, five operators and 14 providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, nine economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: the sole proprietors: Puliaieva O.O., Hrynkiv M.Ia.; TELERADIOKOMPANIIA “AHROTEKHSERVIS PLIUS”, LLC; Kvarts, LLC; HIHATSENTR UKRAINA, LLC; HIHABIT-NET, LLC; TSENTRTELEKOM, LLC; STARHRUP, LLC; UZHNET, LLC.

In connection with the termination of activities in the telecommunications sector, according to the applications of economic entities, NCCIR excluded from “The Register of Telecommunications Operators and Providers” the sole proprietors: Konovalov V.O., Tkachuk N.M., Yeromin V.S., Sorokhan A.L.

According to the applications of economic entity, the Commission issued two licenses for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) to KOMERTSIINA LOHISTYKA, LLC for a term of 5 years in the territory of Dnipropetrovsk and Odesa Oblasts.

Due to the change of a legal entity’s location, NCCIR re-issued nine licenses to Komertsiina lohistyka, LLC for the use of radio frequency resource:

  • for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information):
  • in the territory of Odesa and Sumy Oblasts with the period of validity till March 31, 2021;
  • in the territory of Dnipropetrovsk, Zaporizhzhia and Rivne Oblasts with the period of validity till June 01, 2021;
  • in the territory of Kharkiv and Poltava Oblasts with the period of validity till December 14, 2021;
  • in the territory of Kyiv city and Kyiv Oblast with the period of validity till May 13, 2024;
  • in Kyiv city with the period of validity till April 16, 2024;
  • for broadband radio access (a radio data transmission system using noise-shaped signal):
  • in the territory of Rivne, Zaporizhzhia and Sumy Oblasts with the period of validity till March 31, 2021;
  • in the territory  of Poltava Oblast with the period of validity till May 19, 2021;
  • in the territory of Kharkiv Oblast with the period of validity till June 25, 2023;
  • in Kyiv city with the period of validity till May 27, 2023.

In accordance with paragraph 3 of Part 5 of Article 33 and Part 4 of Article 39 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” (in connection with the unreliability of the data in the documents submitted by the applicant for obtaining a license), the Commission refused to YUTIM, LLC in issuance of a license for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Ivano-Frankivskyi Oblast.

In accordance with paragraph 2 and 3 of Part 5 of Article 33 and Part 4 of Article 39 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” (due to the non-compliance with conditions of electromagnetic compatibility between radio electronic facilities (REF*), which is indicated in the frequency plan of the REFs network with other REFs, and also in connection with the unreliability of the data in the documents submitted by the applicant for obtaining a license), NCCIR has refused to a sole proprietor Isaiev M.M. in issuance of a license for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Kherson Oblast.

In accordance with the paragraph 1 of Part 1 of Article 38 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine”, according to the licensee’s application, the Commission has adopted the decision to cancel a license for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) to a sole proprietor Spichkin A.M. in the territory of Kharkiv Oblast.

In accordance with the Part 6 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” and paragraph 3.5 of License provisions for the use of radio frequency resource of Ukraine, on the basis of documented circumstances that do not allow to start the use of radio frequency resource timely, NCCIR has adopted the decision to reschedule the starting date of the full development of radio frequency resource without changing the period of validity of license for the use of radio frequency resource of Ukraine issued to TELEMEREZHI “YUSANA”, LLC.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF and RC**), the Commission added the information to Section I of the Register of REF and RC about one type of radio facility.

By the same decision, NCCIR provided the manufacturer “Veoneer US, Inc.” (USA) with one code of registration number with the information included to Section II of the Register of REF and RC.

Also, in accordance with Article 26 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Regulations on the Procedure and the Form of Maintaining the Register of REF and RC, upon examination of the applications of Motorola Solutions Ukraine, LLC concerning the possibility of applying the particular type of REF and RC in the territory of Ukraine, and according to the results of technical expertise on issues of electromagnetic compatibility of declared REF type, the Commission identified as possible the use of two types of radio electronic facilities in the territory of Ukraine.

In accordance with the Law of Ukraine “On Radio Frequency Resource of Ukraine” and Section IV of the Procedure for the Importation from Abroad and the Sales in Ukraine of Radio Electronic Facilities and Radiating Circuits, approved by NCCIR decision dated February 13, 2018 No. 78, registered at the Ministry of Justice of Ukraine on March 12, 2018 under No. 282/31734, and taking into account the letters of Ukrainian State Center of Radio Frequencies, State Enterprise and State Fiscal Service of Ukraine, NCCIR has adopted the decision to add into the list of REFs and RC types of the Register of REFs and RC, prohibited for use and import into the territory of Ukraine, the information about two types of radio electronic facilities.

According to the applications of economic entities, the Commission re-issued 19 permits for the use of numbering resource to:

  • Lviv City Municipal Enterprise “Lvivteploenerho” (in connection with the extension of the validity period of the license) – one permit for the use of numbering resource with the capacity of 1.199 phone numbers in Lviv city;
  • SUMSKI TELEKOMSYSTEMY, LLC (in connection with obtaining new licenses) – four permits with the total capacity of 10.000 phone numbers and the final destination signaling code of SS7 network in Sumy city;
  • DISITEL, LLC (in connection with the extension of the validity period of the licenses) – four licenses with the total capacity of 9.100 phone numbers and the final destination signaling code of SS7 network in Zaporizhzhia city;
  • Kyivstar, PJSC (in connection with the extension of the validity period of the licenses) – 10 permits: national identification code 897 of destination network in the territory of Ukraine; the operator code 30 of the global telecommunications service 800 in the territory of Ukraine; two international signaling codes of SS7 network in Kyiv city and one international signaling code of SS7 network in Dnipro city; two codes of SS7 network in the territory of Ukraine; the destination signaling codes of SS7 network in the territory of Ukraine; two transitional signaling codes of SS7 network in Dnipro and Donetsk cities.
