Results of NCCIR meeting dated 26 February 2019
According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 12 positions. “The Unified State Register of Postal Telecommunications Operators” was supplemented with the information of one economic entity. The Commission issued two licenses and extended the validity of one license for operating in telecommunications sector. Also, the Commission issued one license for the use of radio frequency resource of Ukraine and one license for an additional RF bandwidth. These and the other decisions were adopted during the regular NCCIR meeting on February 26, 2019.
According to the Commission’s decision, nine operators and three providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.
Moreover, three economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: TK LINK, LLC; Telekomunikatsiina kompaniia “LINK”, LLC; TELEMIST 2012, LLC.
In connection with the termination of activities in the telecommunications sector, four sole proprietors were excluded from “The Register of Telecommunications Operators and Providers”, as follows: Kulskyi L.O. (in accordance with paragraph 4.1 of the Procedure for maintaining the Register of Telecommunications Operators and Providers); Fomkin V.Iu., Shevchuk F.S. and Trydub V.I. (according to the applications).
In accordance with the Part 6, Article 8 of the Law of Ukraine “On Postal Communication”, Subparagraph 30 of Paragraph 4 of the Regulations on National Commission for the State Regulation of Communications and Informatization, approved by the Decree of the President of Ukraine dated November 23, 2011 No. 1067, with the Procedure for Conducting the Unified State Register of Postal Telecommunications Operators, approved by the NCCIR decision dated 29 November 2016 No. 623 and registered at the Ministry of Justice of Ukraine on December 21, 2016 under No. 1679/29809, on the basis of notification, NCCIR has included information into “The Unified State Register of Postal Telecommunications Operators” about DZHAST IN, LLC, which will provide services for mail receiving, mail processing, transportation and delivery of postal items, execution of consumers’ requests on postal transfers, execution of consumers’ requests on banking operations in the territory of Ukraine and abroad.
According to the economic entity’s application, the Commission issued two licenses for the provision of engineering maintenance services and telecom networks operation for a term of 5 years to: BILINTEKH Ukraina, LLC in the territory of Kyiv city; KHATANET, LLC in the territory of Pereiaslav-Khmelnytskyi city (Kyiv Oblast).
According to the application of YELS TELEKOM, Private Enterprise, NCCIR extended the validity of a license for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use in the territory of Odesa city (Odesa Oblast) from July 16, 2019 till July 15, 2024.
Moreover, the Commission issued to lifecell, LLC a copy of a license for the provision of mobile telephony services with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use all over Ukraine to the telecommunications provider FRINET, LLC without the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use.
According to the application of a sole proprietor Honchar M.I., NCCIR issued a license for the use of radio frequency resource for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in Kirovohrad Oblast for a term of 5 years.
According to the application of SI DI EM EI TSENTR, LLC, the Commission issued a license for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) in Poltava Oblast for a term of 5 years.
Due to decrease in the number of regions and according to the application of Broadcasting, Radiocommunications and Television Concern, NCCIR re-issued a license for radio link communication (radio link communication of fixed radio service) in Poltava and Sumy Oblasts with the period of validity till January 01, 2020.
By the same decision and according to the application of Kyivstar, PJSC, the Commission extended the validity of a license for the use of radio frequency resource for radio link communication (radio link communication of fixed radio service) in Ivano-Frankivsk Oblast from June 14, 2019 till June 13, 2034.
In accordance with the paragraph 2 of Part 2, Part 4 and Part 9 of Article 45 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, taking into account the letter of National Council of Television and Radio Broadcasting of Ukraine concerning the cancellation of a license for broadcasting to Teleradiokompaniia “ZOLOTI VOROTA”, LLC (on the basis of the decision of the County Administrative Court of Kyiv and the order of Sixth Administrative Court of Appeal) and a letter of Ukrainian State Centre of Radio Frequencies, State Enterprise concerning the cancellation of the permit for operation, NCCIR cancelled a permit for REFs* operation for analog sound broadcasting to Teleradiokompaniia “ZOLOTI VOROTA”, LLC, issued on the basis of a license for broadcasting in connection with its cancellation.
In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF and RC**), the Commission added the information to Section I of the Register of REF and RC about two types of radio facilities.
In accordance with Article 26 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Regulations on the Procedure and the Form of Maintaining the the Register of REF and RC, upon examination of the applications of Huawei Ukraine, LLC, NCCIR identified as possible the use of 10 declared types of REFs in the territory of Ukraine.
According to the applications of Ukrtelekom, PJSC, the Commission issued three final destination signaling codes of SS7 network in Vovchansk city (Kharkiv Oblast), Starobilsk city and Bilokurakyne township (Luhansk Oblast) and issued relevant permits for its use.
In accordance with the subparagraph 10.1.4 of the Provisions on the State Regulation of the Number Resource of the Public Telecommunications Network of Ukraine (hereinafter – the Provisions), NCCIR has withdrawn (according to the relevant applications) from:
- lifecell, LLC: a short number 1695 for the organization of a customized social service “Charity fundraising for maintaining law and order in the territory of Zaporizhzhia Oblast” for the use in the mobile communications network with identification codes of mobile communications network 63, 73, 93, 97, 98 in the territory of cities, townships, rural districts of all Oblasts of Ukraine;
- LINKOM-3000, LLC: national identification code 895 of destination network in the territory of Kyiv city and Sevastopol city.
In accordance with the subparagraph 3.4.6 of the Provisions, due to the absence of free numbering resource on the declared territory, the Commission refused to EM AI AI TI, LLC in issuing of numbering resource with the capacity of 100 phone numbers in Kyiv city, because such numbering resource had been issued by NCCIR to telecommunications operator Telesystemy Ukrainy, LLC (in accordance with a permit HP009249 dated September 08, 2017).
