Results of NCCIR meeting dated 12 February 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 15 positions. “The Unified State Register of Postal Telecommunications Operators” was supplemented with the information of one economic entity. The Commission issued five licenses for operating in telecommunications sector. Also, the Commission issued three licenses and re-issued one license for the use of radio frequency resource of Ukraine. NCCIR issued one permit and re-issued two permits for the use of numbering resource. These and the other decisions were adopted during the regular NCCIR meeting on February 12, 2019.

According to the Commission’s decision, five operators and 10 providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, 11 economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: the sole proprietors: Romanchenko V.I., Dubei O.I., Kolomiiets O.A., Ilchyshyn V.M.; LYNKOM, LLC; I-LAN, LLC; VEP-KOMPANI, LLC; SATELIT, Private Enterprise; TV and Radio Company “VEHA”, LLC; TV and Radio Company “IT-3”, LLC; BITTERNET, LLC.

In connection with the termination of activities in the telecommunications sector, six sole proprietors were excluded from “The Register of Telecommunications Operators and Providers”, as follows: Niezhykov H.Ia., Niezhykov I.Ia., Kriukovskyi A.S., Usypenko V.V., Titova I.O. and Yakovenko O.O.

In accordance with the Part 6, Article 8 of the Law of Ukraine “On Postal Communication”, Subparagraph 30 of Paragraph 4 of the Regulations on National Commission for the State Regulation of Communications and Informatization, approved by the Decree of the President of Ukraine dated November 23, 2011 No. 1067, with the Procedure for Conducting the Unified State Register of Postal Telecommunications Operators, approved by the NCCIR decision dated 29 November 2016 No. 623 and registered at the Ministry of Justice of Ukraine on December 21, 2016 under No. 1679/29809, on the basis of notification, NCCIR has included information into “The Unified State Register of Postal Telecommunications Operators” about RMBEI, LLC, which will provide services for mail receiving, mail processing, transportation and delivery of postal items in the territory of Ukraine, the USA, Moldova, Romania, Canada, China.

In connection with the termination of activities and according to the application, NCCIR excluded from “The Unified State Register of Postal Telecommunications Operators” a sole proprietor Babur T.P.

According to the economic entity’s application, the Commission issued five licenses for operating in telecommunications sector for a term of 5 years:

  • for the provision of engineering maintenance services and telecom networks operation to: UKRTEKHNOINNOVEISHN, LLC in the territory of Kyiv city; PALVI TELEKOM, LLC in the territory of Slavutych and Chornobyl cities (Kyiv Oblast); a sole proprietor Yaremenko Yu.V. in the territory of Sumy and Shostka cities (Shostka Raion), Krasnopillia township (Krasnopillia Raion), Krolevets city (Krolevets Raion), Bilopillia city (Bilopillia Raion), Romny city (Romny Raion, Sumy Oblast);
  • for the provision of engineering maintenance services and wired radio networks operation to: UKRTELEKOM, PJSC in the territory of Vinnytsia, Volyn, Dnipropetrovsk, Donetsk, Zhytomyr, Zakarpattia, Zaporizhzhia, Ivano-Frankivsk, Kirovohrad, Luhansk, Lviv, Mykolaiv, Odesa, Poltava, Rivne, Sumy, Ternopil, Kharkiv, Kherson, Khmelnytskyi, Cherkasy, Chernivtsi, Chernihiv Oblasts and Kyiv city;
  • for the provision of fixed local telephony with the network capacity on to 1.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use to ANLIMITED TELEKOM, LLC in the territory of Kharkiv city.

By the same decision, NCCIR issued (according to the application) to lifecell, LLC a copy of a license for the provision of mobile telephony services with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use all over Ukraine to the telecommunications provider “naukovo-vyrobnyche pidpryiemstvo “TENET”, LLC without the right of engineering maintenance and telecom networks operation, providing telecommunication channels in use on the whole territory of Ukraine.

According to the economic entities applications, the Commission issued three licenses for an additional RF bandwidth for a term of 5 years:

  • for broadband radio access (a radio data transmission system using noise-shaped signal) to: SKYTEL UA, LLC in Vinnytsia Oblast; STAR “LINK”, LLC in Dnipropetrovsk Oblast;
  • for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) to INFO PROSTIR PLIUS, LLC in Lviv Oblast.

Due to the change of a place of residence and according to the application of a sole proprietor Balaban O.V., NCCIR re-issued two licenses for the use of radio frequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) and for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) with the period of validity till September 16, 2023 in Zaporizhzhia Oblast.

Moreover, in accordance with Part 3 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Commission canceled the paragraphs 2.1 and 2.2 of NCCIR decision dated December 18, 2018 No. 650 on extending the validity of a license for the use of radio frequency resource of Ukraine to Infolain, LLC and TERA – KOM, LLC, in connection with the failure to provide documents confirming the payment for extending the validity of a license for the use of radio frequency resource of Ukraine.

In accordance with the paragraph 3 of Part 5 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine” (in connection with the unreliability of the data in the documents submitted by the applicant for obtaining a license), NCCIR refused to issue a license for the use of radio frequency resource of Ukraine for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) to a sole proprietor Honchar M.I. in the territory of Kirovohrad Oblast.

In accordance with the paragraph 1 of Part 1 of Article 38 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine”, according to the licensees’ applications, the Commission cancelled three licenses for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) to: Krystal Telekom, LLC in the territory of Kyiv Oblast and a sole proprietor Hrabar O.V. in the territory of Zhytomyr Oblast.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facility and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF* and RC**), the Commission added the information to Section I of the Register of REF and RC about 12 types of radio facilities: seven hand portable radio stations of T42, T62, T82, T92, XT 660d, XT 665d tradenames (manufacturer “Motorola Solutions Germany GmbH”, Germany); two base stations of International Mobile Telecommunication IMT (LTE) system of “Huawei” trade mark with a remote RF unit of RRU5301 and AAU3961 models; (manufacturer “Huawei Technologies Co., Ltd”. China); transmitter of Digital Terrestrial Television Broadcast of DVB-T standard of R&S trade mark of TMU9 model (manufacturer “Rohde & Schwarz GmbH & Ko. Kommanditgesellschaft”, Germany); two high speed wireless routers of InfiLINK 2x2 series of SkyMAN R5000-Smn/5.300.2×300.2×19 and SkyMAN R5000-Mmx/5.300.2×300.2×23 models (manufacturer “Infinet Malta Ltd.”, Malta).

NCCIR provided manufacturer “Nextivity Inc.”, USA with the code of registration number with the information included to Section II of the Register of REF and RC.

The Commission issued according to the application of KYIVSTAR, PJSC a short number 1533 for the organization of customized service “Citizens’ Appeals on Housing and Municipal Services” for the use in the mobile communications network with identification codes of mobile communications network 67, 68, 96, 97, 98 in the territory of Kharkiv city and issued a permit for it use (owner of the services – Municipal Enterprise “Kharkivvodokanal”).

In connection with the extension of the validity period of the license, NCCIR according to the applications of NETHRUP – TELEKOM, Subsidiary Enterprise, re-issued two permits for the use of numbering resource with the capacity of 600 phone numbers and the final destination signaling code of SS7 network in Ivano-Frankivsk city.

According to the operators’ applications, the Commission has withdrawn the following number resource:

  • from VF UKRAINE, PJSC – a short number 1588 for the organization of customized service “Emergency service of electric networks” for the use in the mobile communications network with identification codes of mobile communications network 50, 66, 95, 99 in Kyiv city;
  • from SITEL, LLC – numbering resource with the capacity of 1.000 phone numbers and the final destination signaling code of SS7 network in Brovary city (Kyiv Oblast). Relevant permits for the use of numbering resource revoked.
