Results of NCCIR meeting dated 29 January 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 15 positions. “The Unified State Register of Postal Telecommunications Operators” was supplemented with the information of three economic entities. The Commission issued seven licenses and extended the validity of one license for operating in telecommunications sector. Also, the Commission issued one license and extended the validity of eight licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on January 29, 2019.

According to the Commission’s decision, four operators and 11 providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, six economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”, as follows: the sole proprietors Zavhorodnii V.V.; Kharchenko S.M.; Zaiats M.Ia.; AITIMOLLZ, LLC; Kyivstar, PJSC; “Firma “Meha Stail-Servis”, LLC.

In connection with the termination of activities in the telecommunications sector, the sole proprietors Pashynska O.V., Zahlada Yu.S. and Ocheretianyi Yu.M. were excluded from “The Register of Telecommunications Operators and Providers”.

In accordance with the Part 6, Article 8 of the Law of Ukraine “On Postal Communication”, Subparagraph 30 of Paragraph 4 of the Regulations on National Commission for the State Regulation of Communications and Informatization, approved by the Decree of the President of Ukraine dated November 23, 2011 No. 1067, with the Procedure for Conducting the Unified State Register of Postal Telecommunications Operators, approved by the NCCIR decision dated 29 November 2016 No. 623 and registered at the Ministry of Justice of Ukraine on December 21, 2016 under No. 1679/29809, on the basis of notifications, NCCIR has included information into “The Unified State Register of Postal Telecommunications Operators” about three economic entities:

  • the sole proprietors: Chumachenko S.O. in Kyiv city, Odesa and Kyiv Oblasts; and Davydovych T.R. in the territory of Ukraine and abroad – will provide services for mail receiving, mail processing, transportation and delivery of postal items, execution of consumers’ requests on postal transfers, execution of consumers’ requests on banking operations;
  • a sole proprietor Ivanenko D.M. in the territory of Ukraine – will provide services for mail receiving, mail processing, transportation and delivery of postal items.

According to the economic entities applications, the Commission issued seven licenses for engineering maintenance and telecom networks operation for a term of 5 years to:

  • DTEK SERVIS, LLC – a license in the territory of Zaporizhzhia city, Dnipro city, Zelenodilsk city (Dnipropetrovsk Oblast), Lviv city, Dobrotvir township (Lviv Oblast), Burshtyn city (Ivano-Frankivsk Oblast), Ladyzhyn city (Vinnytsia Oblast);
  • a sole proprietor – six licenses in the territory of Poltavka, Novozlatopil and Liubymivka villages, Uspenivka village (Huliaipole Raion, Zaporizhzhia Oblast), Shevchenko village, Zelene Pole village (Velyka Novosilka Raion, Donetsk Oblast).

According to the application of INFOSEND, LLC, NCCIR extended the validity of a license for the provision of engineering maintenance services and telecom networks operation in the territory of Mariupol city (Donetsk Oblast) from June 03, 2019 till June 02, 2024.

In accordance with Part 2 of Article 49, Part 8 of Article 50 of the Law of Ukraine “On Telecommunications” and due to the failure to comply with the conditions of paragraph 1.20 of License provisions for operating in telecommunications sector providing services of engineering maintenance and telecom networks operation, an on-air TV and radio broadcasting networks, wired radio and telecom networks (within 30 working days the licensee hasn’t submitted an application for license re-issue), NCCIR has adopted the decision to refuse “Naukovo-vyrobnyche pidpryiemtsvo “Traifl”, LLC in extending the validity of a license for the provision of engineering maintenance services and telecom networks operation in the territory of Dnipro city.

According to the application of Vyrobnycho-komertsiina firma “HIUSS”, LLC, the Commission issued a license for the use of radio frequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) in Zaporizhzhia Oblast for a term of 5 years.

NCCIR extended the validity of eight licenses for the use of radio frequency resource of Ukraine:

  • for broadband radio access (a radio data transmission system using noise-shaped signal) to: the sole proprietors: Karpenko H.M. in Sumy Oblast from June 23, 2019 till June 22, 2024; Podkhaliuzin V.Ie. in Donetsk Oblast from July 21, 2019 till July 20, 2024; Pavlyshche N.I. in Zaporizhzhia Oblast from July 02, 2019 till July 01, 2024; Kryvenko S.A. in Cherkasy Oblast from June 25, 2019 till June 24, 2024;
  • for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) to: a sole proprietor Kostik Yu.I. in Mykolaiv Oblast from July 02, 2019 till July 01, 2024; ALIANSNET, LLC in Kharkiv Oblast from May 12, 2019 till May 11, 2024; KOMERTSIINA LOHISTYKA, LLC in Kyiv city and Kyiv Oblast from May 14, 2019 till May 13, 2024;
  • for analog ultra-high frequency wireless telephony (radiocommunications of fixed, terrestrial and marine mobile radio service) to DOLIA I KO. LTD, LLC in Kyiv city from July 07, 2019 till July 06, 2024.

By the same decision, in accordance with Part 3 of Article 33 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine”, the Commission cancelled:

  • the paragraph 2 of NCCIR decision dated December 11, 2018 No. 635 concerning the issuance of a license for an additional RF bandwidth to MEHAPROSTIR, LLC, in connection with the failure to provide documents confirming the payment for the issuance of a license for an additional RF bandwidth;
  • the paragraph 3.1 of NCCIR decision dated December 11, 2018 No. 635 concerning the extension of the validity period of the license for the use of radio frequency resource of Ukraine to NVO SUZIRIA, LLC, in connection with the failure to provide documents confirming the payment for the extension of the validity period of the license for the use of radio frequency resource of Ukraine.

In accordance with paragraph 3 of Part 5 of Article 33 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, in connection with the unreliability of the data in the documents submitted by the applicant for obtaining a license, NCCIR has refused to Spaider Veb, LLC in issuance of a license for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Zhytomyr Oblast.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facilities and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REFs* and RCs**), the Commission added the information to Section I of the Register of REFs and RCs about one type of radio equipment: radiocontrolled quadcopter Phantom 4 RTK (WM334R) with GPS-receiver and remote control panel С1 (GL300N) (manufacturer “SZ DJI Technology Co., Ltd.”, China).
