Results of NCCIR meeting dated 22 January 2019

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 11 positions. The Commission issued one license and extended the validity of one license for operating in telecommunications sector. Also, the Commission issued four, re-issued 22 licenses and extended the validity of one license for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on January 22, 2019.

According to the Commission’s decision, eight operators and three providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

In connection with the termination of activities in the telecommunications sector, NCCIR excluded five economic entities from “The Register of Telecommunications Operators and Providers” according to their application, as follows: the sole proprietors Zhyrnyi S.S., Hushlenko T.S., Novak O.V., Huk O.I, and SMART-NET, LLC.

According to the application, the Commission issued to LINKTELEKOM, LLC a license for engineering maintenance and telecom networks operation in the territory of Kyiv city for a term of 5 years.

According to the application of TEKРNOLOHII MAIBUTNOHO, LLC, NCCIR extended the validity of a license for engineering maintenance and telecom networks operation in the territory of Odesa city from May 26, 2019 till May 25, 2024.

According to the economic entities applications, the Commission issued four licenses:

  • for the use of radio frequency resource for radio link communication (radio link communication of fixed radio service) to SLAVUTYCH-ELEKTROMEREZHI, Municipal Enterprise of Slavutych City Council in the territory of Kyiv and Chernihiv Oblasts for a term of 5 years;
  • for an additional RF bandwidth to:
    • FAUST ISP, LLC – a license for broadband radio access (a radio data transmission system using noise-shaped signal);
    • Ukrkosmos, State Enterprise – a license for satellite radio communication (radio communication of satellite mobile and fixed radio services) in Kyiv city for a term of 5 years;
    • Kyivstar, PJSC – a license for radio link communication (radio link communication of fixed radio service) in Kyiv city and 13 regions of Ukraine for a term of 15 years.

According to the licensees’ applications, NCCIR re-issued 22 licenses for the use of radio frequency resource:

  • due to reorganization of business entity’s legal entity by joining to FARLEP – INVEST, PJSC:
    • licenses for broadband radio access (a radio data transmission system using noise-shaped signal) within the territory of Lviv Oblast with the period of validity till March 01, 2020 and in Donetsk Oblast with the period of validity till May 18, 2020;
    • for multiservice radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information): a license in the territory of Dnipropetrovsk and Odesa Oblasts with the period of validity till April 03, 2026; a license in the territory of eight Oblasts of Ukraine, Autonomous Republic of Crimea and Sevastopol city with the period of validity till January 20, 2020; a license in the territory of Zakarpattia, Ternopil, Ivano-Frankivsk, Chernihiv Oblasts with the period of validity till September 06, 2020; a license in the territory of Cherkasy and Chernivtsi Oblasts with the period of validity till May 02, 2026; a license within the territory of Kyiv city and Dnipropetrovsk, Donetsk, Odesa, Kharkiv, Zaporizhzhia Oblasts with the period of validity till December 08, 2021; the licenses in the territory of Kyiv, Mykolaiv, Kherson and Zhytomyr Oblasts with the period of validity till January 20, 2020; the lisences in the territory of Ternopil, Ivano-Frankivsk and Chernihiv Oblasts with the period of validity till September 06, 2020; the licenses in the territory of Chernivtsi Oblast with the period of validity till December 27, 2019; the licenses in the territory of Poltava, Khmelnytskyi, Volyn, Rivne, Ternopil and Cherkasy Oblasts with the period of validity till May 02, 2026; a license in the territory of 13 Oblasts, Autonomous Republic of Crimea and Sevastopol city with the period of validity till May 02, 2026; a license in the territory of Zaporizhzhia Oblast with the period of validity till December 23, 2022; a license within the territory of Volyn, Poltava, Rivne, Cherkasy and Khmelnytskyi Oblasts with the period of validity till May 02, 2026; the licenses in the territory of Vinnytsia, Zhytomyr, Kyiv, Lviv, Mykolaiv, Sumy and Kherson Oblasts with the period of validity till January 20, 2020; the licenses in the territory of Chernivtsi Oblast with the period of validity till December 27, 2019 and till October 03, 2021;
    • for multiservice radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information): the licenses in the territory of Kyiv city and Kharkiv, Donetsk, Dnipropetrovsk, Zaporizhzhia and Odesa Oblasts with the period of validity till November 30, 2019, and in Donetsk Oblast with the period of validity till October 30, 2019; a license in the territory of Kyiv city, Kharkiv, Donetsk, Dnipropetrovsk Oblasts with the period of validity till November 30, 2019; a license in the territory of Kyiv city with the period of validity till May 24, 2020;
  • due to decrease in the number of regions – a license for radio link communication in the territory of eight Oblasts of Ukraine to Kyivstar, PJSC with the period of validity till August 16, 2019.

According to lifecell, LLC application, NCCIR extended the validity of a license for the use of radio frequency resource for radio link communication (radio link communication of fixed radio service) in the territory of Kyiv city and 24 regions of Ukraine from May 13, 2019 till May 12, 2024.

In accordance with the paragraph 1 of Part 1 of Article 38 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine”, according to the application of EM AI AI TI, LLC, the Commission cancelled a license for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Kyiv city.

In accordance with the paragraph 1 of Part 2 and Part 4 of Article 45 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, in connection with the cancellation of a license for the use of radio frequency resource of Ukraine, NCCIR cancelled five permits for the REFs* operation to a sole proprietor Mishchenko P.O.

In accordance with the paragraphs 10-12 of the Technical Regulations of Radio Facilities and the Regulations on the Procedure and Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (the Register of REF and RC**), the Commission added the information to Section I of the Register of REF and RC about three car radar devices of “Continental” trademark (SRR2-A, SRR3-A and SRR3-B models) (manufacturer “ADC Automotive Distance Control Systems GmbH”, Germany).

Additionally, NCCIR provided the manufacturers “HELLA GmbH & Co. KGaA”, Germany, and “Infinet Malta Ltd”, Malta, with the codes of registration numbers with the information included to Section II of the Register of REF and RC.

Moreover, the Commission made changes to the position 1088 of Section IV of the Register of REF and RC.

In accordance with Article 26 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Regulations on the Procedure and Form of Maintaining the the Register of REF and RC, and upon examination of the application of Farlep-Invest, PJSC, NCCIR identified as possible the use in the territory of Ukraine of subscriber transmitting device of IVA-23/28 model (manufacturer “Televideo”, LLC, Ukraine).
