Results of NCCIR meeting dated 07 August 2018

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 12 positions. The Commission issued two licenses for operating in telecommunications sector and three licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on August 07, 2018.

According to the Commission’s decision, three operators and nine providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, 20 economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”.

In connection with the termination of activities in the telecommunications sector, five economic entities were excluded from “The Register of Telecommunications Operators and Providers”: sole proprietors Svetlova A.O., Skorodumov H.V., Makarenko O.V., PJSC “Northern Mining and Processing Plant”, LLC “Lurenet.com”.

According to the economic entities’ applications, NCCIR issued two licenses for engineering maintenance and telecom networks operation for a term of 5 years: Private Enterprise “NTTS Novi tekhnolohii” in the territory of Kryvyi Rih city (Dnipropetrovsk Oblast), LLC “TV and Radio Company “TIM” in the territory of Pryluky city (Chernihiv Oblast).

The Commission has extended the validity of three licenses to:

  • Private Enterprise “VIK Telekom” – a license for engineering maintenance and telecom networks operation in the territory of Khmilnyk city (Vinnytsia Oblast) from December 20, 2018 till December 19, 2023;
  • LLC “UKRKOM” – two licenses: a license for the provision of fixed local telephony (except for departmental objects) with the right to create its own network capacity of more than 1.000 phone numbers in the territory of Kyiv Oblast from January 30, 2019 till January 29, 2024; and a license for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels for the use in the territory of Cherkasy city and Cherkasy Oblast from December 11, 2018 till December 10, 2023.

According to the licensees’ applications, NCCIR has cancelled two licenses for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels for the use to: Small Private Enterprise “KOSMET-P” in the territory of Odesa Oblast; and LLC “AVATOR ISP” in the territory of Poltava Oblast.

According to LLC “FAIERBIT” application, NCCIR issued a license for the use of radio frequency resource of Ukraine for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Kyiv city for a term of 5 years.

Moreover, the Commission issued two licenses for an additional RF bandwidth to:

  • a sole proprietor Rumiantseva O.V. – a license for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Poltava Oblast for a term of 5 years;
  • PJSC “VF UKRAINA” – a license for radio link communication (radio link communication of fixed radio service) in the territory of Kyiv city and 13 regions of Ukraine for a term of 15 years.

NCCIR has extended the validity of two licenses for the use of radio frequency resource of Ukraine to:

  • A sole proprietor Stefanets R.Ia. – a license for broadband radio access (a radio data transmission system using noise-shaped signal) from December 10, 2018 till December 09, 2023 within Ternopil Oblast;
  • LLC “VEDEKON” – a license for the use of radio frequency resource for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Zhytomyr, Kyiv, Poltava and Kharkiv Oblast from March 06, 2019 till March 05, 2024.

Due to the non-compliance with conditions of electromagnetic compatibility between radio electronic facility (REF*), which is indicated in the frequency plan of the REFs network with other REFs, NCCIR has refused to issue a license for an additional RF bandwidth for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) to LLC “MEHAPROSTIR” in the territory of Mykolaiv Oblast.

In accordance with Article 26 of the Law of Ukraine “On Radio Frequency Resource of Ukraine”, the Regulations on the Procedure and the Form of Maintaining the Register of Radio Electronic Facilities and Radiating Circuits that may be applied in the territory of Ukraine in common bands (public radio frequency bands) (hereinafter – REFs and RC**), and upon examination of the applications of LLC “AV DISTRIBUTION”, LLC “MILLENIUM TRADE” and LLC “FLY TECHNOLOGY” concerning the possibility of applying the particular types of REFs and RC in the territory of Ukraine, and according to the result of technical expertise on issues of electromagnetic compatibility, the Commission identified as possible the use of three declared types of radio electronic facilities and radiating circuits.

In accordance with the Law of Ukraine “On Radio Frequency Resource of Ukraine” and Section IV of the Procedure for the Importation from Abroad and the Sales in Ukraine of Radio Electronic Facilities and Radiating Circuits, taking into account the letter of the State Enterprise “Ukrainian State Center of Radio Frequencies”, the Commission has entered the information into the list of REFs and RC types of the Register of REFs and RC, prohibited for use and import into the territory of Ukraine, as follows:

  • radio communications jammers (jammer stations); devices of the type “jammer”, “Wi-Fi jammer”, “IMSI-catcher”, “GSM/CDMA/UMTS/LTE Interceptor”, “2G/3G/4G Interceptor”, “Cellular Interceptor”;
  • fixed-line telephones (stationary phones) with cordless phone of DECT 6.0; DECT 6.0 wireless subscriber voice terminals (Handset Cordless Phone); DECT 6.0 cordless phones (cordless phones) that contain a transmitter and a receiver that operates in 1920-1930 MHz RF bandwidth.
