Results of NCCIR meeting dated 10 April 2018

According to NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 13 positions. “The Unified State Register of Postal Telecommunications Operators” was supplemented with the information of one economic entity and the Commission issued two licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on April 10, 2018.

According to the Commission’s decision, five operators and eight providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, seven economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”.

In connection with the termination of activities in the telecommunications sector, the sole proprietors Voloshyna O.P. and Korcheva O.M. were excluded from “The Register of Telecommunications Operators and Providers”.

In accordance with the Part 6, Article 8 of the Law of Ukraine “On Postal Communication”, Procedure for Conducting the Unified State Register of Postal Telecommunications Operators, approved by the NCCIR decision dated 29 November 2016 No. 623 and registered at the Ministry of Justice of Ukraine on December 21, 2016 under No. 1679/29809, on the basis of notification of entering the information into “The Unified State Register of Postal Telecommunications Operators”, NCCIR has included information into “The Unified State Register of Postal Telecommunications Operators” about LLC “BELMONT”, which will provide services for mail receiving, mail processing, transportation and delivery of postal items, execution of consumers’ requests on postal transfers, execution of consumers’ requests on banking operations in the whole territory of Ukraine, except the territories that are recognized as temporarily occupied; international mail receiving, processing and transportation, and also execution of consumers’ requests on postal transfers from the territory of EU countries (Belgium, Germany, Italy, Luxembourg, the Netherlands, France, Great Britain, Denmark, Ireland, Greece, Portugal, Spain, Austria, Finland, Sweden, Latvia, Lithuania, Estonia, Malta, Poland, Slovakia, Slovenia, the Czech Republic, Hungary, Cyprus, Bulgaria, Romania, Croatia), and also the Middle East countries, as follows: Israel, Turkey, Egypt and Syria.

NCCIR has adopted the decision to issue a license for engineering maintenance and operation of an on-air radiobroadcasting networks in the whole territory of Ukraine.

The Commission has extended the validity of two licenses for:

  • TV and Radio Company “Vektor” in LLC form – a license for engineering maintenance and telecom networks operation in the territory of Lozova city, township of Krasnopavlivka (Kharkiv Oblast) from August 06, 2018 till August 05, 2023;
  • a sole proprietor Maksymov S.V. – a license for engineering maintenance and telecom networks operation in the territory of Bashtanka city (Mykolaiv Oblast) from August 12, 2018 till August 11, 2023.

According to the application of a sole proprietor Shapoval R.M., NCCIR has cancelled a license for engineering maintenance and telecom networks operation in the territory of Brody city (Lviv Oblast).

Due to violation of the deadline for submitting an application, State Enterprise “Ukrainian Sea Ports Authority” was refused in extending the validity of a license and issuing the copy of its license for the provision of fixed local telephony with the network capacity on to 10.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Mykolaiv Oblast.

NCCIR has issued two licenses to economic entities for the use of radio frequency resource of Ukraine:

  • LLC “IT TELESET” – a license for broadband radio access (a radio data transmission system using noise-shaped signal) in Kyiv city;
  • LLC “PIVNICH LAIN” – a license for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Rivne Oblast.

By the same decision, NCCIR has extended the validity of eight licenses for the use of radio frequency resource of Ukraine to:

  • a sole proprietor Balaban V.V. – a license for broadband radio access (a radio data transmission system using noise-shaped signal) from September 18, 2018 till September 16, 2023 in the territory of Zaporizhzhia Oblast;
  • a sole proprietor Makymov S.V. – a license for broadband radio access (a radio data transmission system using noise-shaped signal) from August 21, 2018 till August 20, 2023 within Mykolaiv Oblast;
  • a sole proprietor Karpenko H.M. – a license for broadband radio access (a radio data transmission system using noise-shaped signal) from September 04, 2018 till September 03, 2023; a license for broadband radio access (a radio data transmission system using noise-shaped signal) from October 23, 2018 till October 22, 2023 and a license for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) from September 04, 2018 till September 03, 2023 within Sumy Oblast;
  • PJSC “Ukrtelekom” – a license for radio link communication of fixed radio service from August 28, 2018 till August 27, 2023 in the territory of Rivne Oblast and Kyiv city;
  • PJSC “DORIS” – a license for radio link communication of fixed radio service from August 12, 2018 till August 11, 2023 within Luhansk Oblast and a license for radio link communication of fixed radio service from August 12, 2018 till August 11, 2023 within Donetsk Oblast.

The Commission took notice that in accordance with Part 7 of Article 34 of the Law of Ukraine “On the Radio Frequency Resource of Ukraine” and taking into account Paragraph 2, Part 1 of Article 34 of this Law, the license issued for a sole proprietor Mykhalchuk S.M. for the use of radio frequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Volyn Oblast is not valid.

In connection with the unreliability of the data in the documents submitted by the applicants for obtaining a license, NCCIR has adopted the decision to refuse in issuance of a license to:

  • LLC “DNIPROLINK” – a license for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Dnipropetrovsk Oblast;
  • LLC “MEHAPROSTIR” – a license for an additional RF bandwidth for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Mykolaiv Oblast.

In order to bring “The Register of Radio Electronic Facilities and Radiating Circuits” (hereinafter – The Register of REFs* and RC**), that can be used in the territory of Ukraine in RF bandwidth of common use in accordance with the requirements of the Resolution of the Cabinet of Ministers of Ukraine dated March 28, 2018 No. 218 “On Amending the Plan for the Use of Radio Frequency Resource of Ukraine” concerning the end date for using the technology of “Analog TV broadcasting”, the Commission has made changes regarding information in “The Register of REFs and RC”, that can be used in the territory of Ukraine in RF bandwidth of common use, having published a note OV4 (on the operation of TV transmitters) in a new edition.
