Results of the NCCIR meeting dated 01 August 2017

According to the NCCIR decision, “The Register of Telecommunications Operators and Providers” was supplemented with 14 positions. The Commission issued three and extended the validity of two licenses for operating in the telecommunications sector, and also issued two and extended the validity of three licenses for the use of radio frequency resource of Ukraine. These and the other decisions were adopted during the regular NCCIR meeting on August 01, 2017.

According to the Commission’s decision, four operators and ten providers were added to “The Register of Telecommunications Operators and Providers” on the basis of market participants’ applications.

Moreover, seven economic entities have informed the Commission of change in the contact details, the type of activity or the territory of activity to make relevant information in “The Register of Telecommunications Operators and Providers”.

In the context of the termination of activities in the telecommunications sector and according to the relevant statement – LLC “LAKY LINK” was excluded from “The Register of Telecommunications Operators and Providers”.

NCCIR has adopted the decision to issue three licenses for the provision of engineering maintenance and telecom networks operation for a term of 5 years to:

  • LLC “TK VA SPEIS” in the territory of Shostka city (Sumy Oblast);
  • a sole proprietor Dobravskyi Ye.V. in the territory of Kharkiv city;
  • Municipal Enterprise “Infoservis” of Sumy City Council in the territory of Sumy city.

With a change of LLC Research and Production Association “INTERMET” legal entity’s location, two licenses were re-issued according to NCCIR decision: for the provision of engineering maintenance and telecom networks operation in the territory of Marianivka village (Starobeshivskyi Raion, Donetsk Oblast) and for the provision of engineering maintenance and telecom networks operation in the territory of Donetsk city.

By the same decision, NCCIR has extended the validity of two licenses to:

  • LLC “VAK” for the provision of fixed local telephony (except for departmental objects) with the right to create its own network capacity on to 1.000 subscriber numbers in the territory of Poltava city and Poltava Oblast from November 29, 2017 till November 28, 2022;
  • PJSC “DORIS” for the provision of fixed local telephony with a capacity on to 1.000 phone numbers with the right of engineering maintenance and telecom networks operation, providing telecommunication channels in the territory of Donetsk city and Donetsk Oblast from November 12, 2017 till November 11, 2022.

According to the licensee’s relevant application, NCCIR has adopted the decision to revoke a license for the provision of engineering maintenance and telecom networks operation in the territory of Kyiv and Odesa cities.

In accordance with the Law of Ukraine “On Telecommunications” and on the basis of act of inspection on statutory compliance on telecommunications, NCCIR (by the separate decision) has issued an order to eliminate the breaches of license provisions in the telecommunications sector to State Enterprise “Malyshev Plant”.

NCCIR has adopted the decision, according to the relevant application of LLC “YE VAI FAI”, to issue a license for the use of radiofrequency resource for broadband radio access (a radio data transmission system using noise-shaped signal) in Kyiv city and in the territory of Kyiv Oblast.

LLC “DIAMANT TREID” has been issued a license for an additional RF bandwidth for the use of radio frequency resource for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) in the territory of Kyiv Oblast.

By the same decision, NCCIR has extended the validity of three licenses for the use of radio frequency resource of Ukraine to:

  • LLC “VEDEKON” for broadband radio access (a radio data transmission system using noise-shaped signal) in the territory of Donetsk, Zhytomyr, Poltava, Rivne, Kharkiv and Khmelnytskyi Oblast from January 20, 2018 till January 19, 2023;
  • LLC “EMPLOT” for broadband radio access (a radio data transmission system using noise-shaped signal) in Kyiv city and in the territory of Kyiv Oblast from February 05, 2018 till February 04, 2023;
  • LLC Research and Development Enterprise “VARTA” for analog trunked radiocommunication in Kyiv city from December 26, 2017 till December 25, 2022.

Due to the unreliability of the data in the documents submitted by the applicant and in connection with a requirements of paragraph 3.9 of License provisions for use of radio frequency resource of Ukraine, NCCIR has adopted the decision to refuse a Small Private Enterprise “Kvant - II” on issuing a license on additional RF bandwidth for broadband radio access (radio communication in multichannel distribution systems for the transmission and retransmission of TV image, sound transmission, digital information) within Ivano-Frankivsk Oblast.

According to the Broadcasting, Radiocommunications and Television Concern licensee’s application, NCCIR has revoked a license for the use of radio frequency resource of Ukraine for radio link communication (radio link communication of fixed radio service) in the territory of Kherson Oblast.

In order to bring the decisions of NCCIR in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated February 14, 2017 No. 367 “On Amendments to the National Table of Radio Frequency Allocation of Ukraine and the Plan for the Use of the Radio Frequency Resource of Ukraine” in relation to radio technologies “International Mobile Telecommunications (IMT)” and “Multiservice radio access” within the range of RF bandwidths 2 500-2 690 MHz and “Radio Link Communication” within the range of RF bandwidths 14.4-15.35 GHz (regarding the determination of the possibility of using radio electronic facilities in the territory of Ukraine), the Commission has made alterations to some NCCIR decisions.

In order to bring the Register of Radio Electronic Facilities and Radiating Circuits that can be used in the territory of Ukraine in RF bandwidth of common use (hereinafter – the Register of REFs* and RC**) in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated February 14, 2017 No. 367 “On Amendments to the National Table of Radio Frequency Allocation of Ukraine and the Plan for the Use of the Radio Frequency Resource of Ukraine” in relation to radio technologies “International Mobile Telecommunications (IMT)” and “Multiservice radio access” within the range of RF bandwidths 2 500-2 690 MHz and “Radio Link Communication” within the range of RF bandwidths 14.4-15.35 GHz (regarding the determination of the possibility of using radio electronic facilities in the territory of Ukraine), the Commission has made alterations to the information in the Register of REFs and RC.

According to the Commission’s decision, 30 new types of facilities were added to “The Register of REFs and RC”.

Moreover, upon examination of the applications of LLC “Forteza-Pivden”, representation office of “ZTE Corporation” and LLC “L&G Metering” concerning the possibility of applying the particular type of REFs and RC in the territory of Ukraine and according to the results of technical expertise on issues of electromagnetic compatibility of declared REFs types, the Commission identified as possible the use of 3 types of radio electronic facilities.

NCCIR identified the impossibility of using two types of REFs made by “Landis+Gyr GmbH” (Germany) because the parameters of these REFs fail to meet the requirements of the declared harmonized European standard ETSI EN 302 208-2.
